License for use of the webSDA webserver

Heidelberg Institute for Theoretical Studies, HITS gGmbH (HITS), owns the webSDA software and its associated documentation ("Software"). You should carefully read the following terms and conditions before using this software. Your use of this Software indicates your acceptance of this license agreement and all terms and conditions. You are hereby granted a non-exclusive and non-transferable license to use the Software according to the following terms and conditions.

1. Commercial Use

   The webserver edition of webSDA is free for use for non-profit purposes. If you desire to use webSDA in webserver or standalone versions at your site for profit-making or commercial purposes, you agree to negotiate in good faith a license with the HITS prior to such profit-making or commercial use. The HITS shall have no obligation to grant such license to you, and may grant exclusive or non-exclusive licenses to others. You agree to notify the HITS of any inquiries you have for commercial use of the Software and/or its modifications. 2. Governing Law

   This Agreement is governed by the law of the Federal Republic of Germany. The application of the UN Convention on the Sale of Goods is excluded.

3. Disclaimer of Warranty

   Because this software is licensed free of charge, there is no warranty for the program. The HITS makes no warranty or representation that the operation of the software in this compilation will be error-free, and the HITS is under no obligation to provide any services, by way of maintenance, update, or otherwise. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE LICENSED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

4. Limitation of Liability

   IN NO EVENT WILL HITS gGmbH, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF HITS gGmbH OR ANOTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Termination

   This agreement is effective until terminated. This agreement will terminate immediately without notice from HITS gGmbH if you fail to comply with any of the terms and conditions of this license. This agreement will also terminate immediately without notice from the HITS gGmbH if it is found to implement patented algorithms or contain copyrighted code not owned or licensed the HITS for the purpose of its inclusion in the webSDA software. This agreement cannot be terminated by any other mechanism or for any other reason than those stated herein.

6. Publications

   In any publication describing results from use of this webserver, the URL https://websda.h-its.org/webSDA should be cited along with the publications describing the method listed on the references webpage.

7. Place of Court

   The exclusive venue for all disputes arising from or in connection with this Agreement is Mannheim, Germany (HRB 337446), when the Licensee is a business person, a legal entity governed by public law, or a special fund governed by public law, or does not have a general place of jurisdiction within the Federal Republic of Germany.
